In consideration for receiving permission to participate with FINEST CITY SAN DIEGO TOURS LLC, in a sightseeing tour (hereinafter “Tour”) I, THE UNDERSIGNED, AGREE TO THIS RELEASE OF ALL CLAIMS, WAIVER OF LIABILITY AND ASSUMPTION OF RISK (“Waiver and Release”). I, the participant, waive any and all claims I may have now and in the future, and release from all liability and agree not to sue FINEST CITY SAN DIEGO TOURS LLC; its officers, agents, representatives, employees, tour guides, attorneys, representatives, parents, subsidiaries, subdivision, affiliated or related entities, affiliates, executors, administrators, predecessors, successors and assign (hereafter referred to as “Staff”) for any personal injury, death, property damage, or loss sustained by me as a result of my participation in a tour or experience offered by FINEST CITY SAN DIEGO TOURS LLC, due to any cause whatsoever, including without limitation, negligence on the part FINEST CITY SAN DIEGO TOURS LLC; its Staff, tour partners, or other participants, or death or injury as a result of war, civil unrest or epidemic. I further agree that if I violate this agreement and attempt to bring suit against any part of parties named herein, that I will be held responsible for attorney’s fees and any costs incurred by that person in defending such action.

I am aware that the tours and events offered, in addition to the usual dangers and risks inherent, has certain additional dangers and risks, some of which include: physical exertion for which I may not be prepared and weather extremes subject to sudden and unexpected change. I ACCEPT ALL THE INHERENT RISKS OF THE PROPOSED TOUR AND THE POSSIBILITY OF PERSONAL INJURY, DEATH OR PROPERTY DAMAGE OR LOSS RESULTING THEREFROM. I acknowledge that the enjoyment and excitement of the proposed form of tour or event is derived in part from the inherent risks incurred by travel and activity beyond the accepted safety of life at home or work, and these inherent risks contribute to such enjoyment and excitement, being a reason for my participation. I agree that if I suffer injury or illness, FINEST CITY SAN DIEGO TOURS LLC, or its Staff can, at my cost, arrange any medical treatment and emergency evacuation service as it or they deem necessary for my health and safety. Further, I agree at all times during the tour, to abide by and comply with any additional instructions given by my tour guide or any other Staff and I accept that non-compliance may result in injury, death or permanent disability. I understand that non-compliance may result in my removal from the tour.

I understand and acknowledge that the Tour involves transportation by various motor vehicles, including, but not limited to a shuttle, van or bus transportation. I acknowledge and understands the inherent risks associated with these methods of transportation and acknowledges that I DO NOT HAVE ANY MEDICAL CONDITION(S) THAT WOULD PREVENT ME FROM USING THESE METHODS OF TRANSPORTATION OR THAT WOULD RESULT IN ANY INJURY OR HARM TO ME AS A RESULT OF USING THESE METHODS OF TRANSPORTATION. While I understands and agree that FINEST CITY SAN DIEGO TOURS LLC, will exercise ordinary and reasonable care in the operation of any motor vehicle used for conveyance on the Tour, I understands that FINEST CITY SAN DIEGO TOURS LLC, assumes no responsibility, nor does it grant any express or implied warranties relating to other third parties, including other drivers of motor vehicles. In consideration of my participation in the various activities that comprise the Tour, I understand and accept the risks associated with participation in these various activities and agree that neither FINEST CITY SAN DIEGO TOURS LLC; nor any of its officers, members, managers, directors, agents, employees, volunteers, independent contractors, vendors, business partners, or any other individuals or entities associated with FINEST CITY SAN DIEGO TOURS LLC, will be liable for any personal injury, death or damage of any kind whatsoever.

I AGREE AND ACKNOWLEDGE THAT FINEST CITY SAN DIEGO TOURS LLC, SHALL NOT BE RESPONSIBLE OR LIABLE FOR ANY LOSS, THEFT OR DAMAGE WHATSOEVER TO ANY PERSONAL PROPERTY BROUGHT ON THE TOUR BY ME, WHICH MAY OCCUR ON OR DURING THE TOUR AND ANY PERSONAL ITEMS LEFT IN TOUR BUS/VEHICLE. I hereby expressly waive any claim which I, my heirs, successors, assigns, spouse, family members, or legal representatives may have against FINEST CITY SAN DIEGO TOURS LLC, arising from or as a result of any such loss, theft or damage. It is therefore understood that all personal property that I bring on the Tour is brought at my sole risk and is my sole responsibility.

I acknowledge that there is an inherent risk of exposure to COVID-19 in any public place where people are present. By participating in the tour, I VOLUNTARILY ASSUME ALL RISKS RELATED TO COVID-19 OR ANY DISEASE, AND AGREE TO HOLD HARMLESS FINEST CITY SAN DIEGO TOURS LLC , AND ANY OF THEIR STAFF, OR CONTRACTORS LIABLE FOR ANY INJURY OF ILLNESS OR INJURY RELATED TO COVID-19 OR ANY DISEASE.

In entering this Waiver and Release, I am not relying on any oral, written nor visual representations or statements by FINEST CITY SAN DIEGO TOURS LLC, or its Staff or any other inducement or coercion to go on the tour. I confirm that, by my own free will, I have read and understood the Terms and Conditions of this tour or event, and this Wavier and Release, and agree that this Waiver and Release will be binding upon my heirs, successors, assigns, spouse, family members, and/or legal representatives.

I HEREBY AGREE TO INDEMNIFY AND HOLD HARMLESS FINEST CITY SAN DIEGO TOURS LLC, AND ITS STAFF FROM ANY LOSS, LIABILITY, DAMAGE OR COSTS, INCLUDING COURT COSTS AND ATTORNEY FEES, THAT THEY MAY INCUR DUE TO MY PARTICIPATION IN SAID ACTIVITY, WHETHER CAUSED BY NEGLIGENCE OF FINEST CITY SAN DIEGO TOURS LLC, AND ITS STAFF OR OTHERWISE.

I HEREBY AGREE TO INDEMNIFY AND HOLD HARMLESS FINEST CITY SAN DIEGO TOURS LLC, AND ITS STAFF FROM ANY LOSS, LIABILITY, DAMAGE OR COSTS, INCLUDING COURT COSTS AND ATTORNEY FEES, THAT THEY MAY INCUR DUE TO MY PARTICIPATION IN SAID ACTIVITY, INCLUDING ANY INJURIES OR DEATH  THAT HAPPEN OUTSIDE OF THE TOUR BUS/VEHICLE AT ANY OF THE TOUR STOPS & LOCATIONS DURING THE TOUR.

IN SIGNING THIS RELEASE, I ACKNOWLEDGE AND REPRESENT THAT: I have read the foregoing Waiver Of Liability And Assumption Of Risk document, understand it and sign it voluntarily as my own free act and deed; no oral representations, statements, or inducements, apart from the foregoing written agreement, have been made; I am at least eighteen (18) years age and fully competent; and I execute this Release for full, adequate and complete consideration fully intending to be bound by same.

If participant is under the age of 18, the parent or guardian HAS READ AND VOLUNTARILY SIGNS THE WAIVER AND RELEASE OF LIABILITY AND INDEMNITY AGREEMENT AND DOES SO VOLUNTARILY AND WITH THE UNDERSTANDING THAT SUBSTANTIAL RIGHTS ARE BEING GIVEN UP. Parent/guardian consents to the minor’s participation in the tour, consents for FINEST CITY SAN DIEGO TOURS LLC, to seek reasonable and necessary medical treatment for participants during such event or associated activities and agrees to be responsible for any cost of such treatment.

PLEASE ARRIVE 15 MINUTES EARLY. TOURS WILL DEPART ON TIME. If you are late we will make every effort to get you on the next available tour, but we cannot guarantee availability and will not offer a refund in the event of missing your tour.

Customers must give 72 hours (3 days) notice of cancellation to receive a full refund or credit. Customers will receive a full refund or credit in case tour is cancelled due to weather or other unforeseen circumstances. Contact us by phone to cancel or inquire about a cancellation.
Tours may be cancelled at short notice at FINEST CITY SAN DIEGO TOURS LLC discretion. If a tour is cancelled, paid guests will have the opportunity to either reschedule for the next available tour, or obtain
